By accessing or using the SUNSIDE platform ("Platform"), operated by Sunside Movie Italy S.R.L.s. ("we", "us", or "our"), you expressly agree to be legally bound by these Terms of Service ("Terms"). These Terms constitute a legally binding agreement between you (the "User") and SUNSIDE.

We reserve the right to modify these Terms at any time. Substantial changes will be communicated via email at least thirty (30) days prior to taking effect. Your continued use of the Platform following such notification constitutes acceptance of the revised Terms.


2. Detailed Service Description

SUNSIDE provides an online marketplace facilitating connections between:

A. Service Providers

  • Film/media professionals (actors, crew members, technicians)
  • Owners of rentable resources (equipment, vehicles, properties)

B. Clients

  • Production companies
  • Independent filmmakers
  • Casting agencies

Core Platform Features Include:

  • Matchmaking System: Algorithm-based matching considering experiences, availability, and project requirements
  • Booking Management: Integrated calendar, contract templates, and payment processing
  • Verification Services: Identity verification for providers and resource authenticity checks
  • Collaboration Tools: Secure messaging and file sharing for project coordination

3. Data Collection and GDPR Compliance

3.1 Collected Data Types

A. Mandatory User Data

  • Identity Information: Full name, date of birth, tax ID
  • Contact Details: Email, phone number, physical addresses
  • Professional Data: Occupation, experiences, certifications
  • Physical Characteristics: Height, weight, eye/hair color, sizes
  • Resource Listings: Equipment specifications, property details

B. Optional Data

  • Profile photos/media
  • Work portfolio samples
  • Availability schedules

Upon account termination:

4. User Obligations

A. Service Providers Must:

  • Maintain accurate availability and resource status
  • Honor booked commitments unless legally prevented
  • Update physical/equipment changes within 72 hours
  • Maintain professional conduct and adhere to ethical standards

B. Clients Must:

  • Provide complete project specifications
  • Make timely payments through Platform channels
  • Respect provider cancellation policies
  • Respect the rights and safety of service providers

5. Intellectual Property

All user-generated content (profiles, resource listings) remains owned by users but grants SUNSIDE a non-exclusive, royalty-free license to display and distribute within the Platform. SUNSIDE may also use user-generated content for promotional purposes, such as featuring profiles in marketing materials.

7. Liability Limitations

SUNSIDE is not liable for:

  • User misrepresentations of experiences/resources
  • Contractual disputes between users
  • Third-party service interruptions

8. Account Termination

Either party may terminate accounts with 30 days notice. Immediate termination may occur for:

  • Material GDPR violations
  • Repeated contract breaches
  • Fraudulent activity

9. Dispute Resolution Framework

9.1 Formal Process

  1. Mediation: Mandatory 30-day negotiation period
  2. EU Users: Exclusive jurisdiction of Rome courts
  3. Non-EU Users: Binding arbitration under AAA Commercial Rules

9.2 Service Guarantees

While we strive for 99.9% uptime, SUNSIDE is not liable for:

  • Third-party service failures
  • Force majeure events
  • Scheduled maintenance under 48h

10. Governing Law

These Terms are governed by Italian law. Disputes shall be resolved in italian courts.


11. Payment and Subscription Terms

11.1 Payment Processing

Payment for our services may be processed through various payment processors including:

  • Google Play Billing (for Android app users)
  • Apple In-App Payments (for iOS app users)
  • Other payment processors as made available on the Platform

By using these payment services, you agree to comply with their respective terms and conditions.

11.2 Subscription Plans

We offer the following subscription options:

  • Free Plan: Basic visibility with limited features (3 photos, 1 YouTube video URL, 1 resource listing, 3 past experience entries)
  • Pro Plan (Founder Pricing - Currently Available): €1.99/month or €19.99/year, includes enhanced visibility, priority support, 10 photos, 5 YouTube video URLs, 5 resource listings, 20 past experience entries, founder badge, priority ranking in searches, and upcoming features like minors management and analytics (coming soon)
  • Pro Plan (Standard Pricing - Future Release): €9.99/month or €99.99/year, will include the same features as above except the founder badge

11.3 Subscription Management

  • You may downgrade your subscription at any time through your account settings
  • When downgrading from Pro to Free plan, any content that exceeds the Free plan limits will be hidden but not deleted
  • This content will become visible again if you resubscribe to a Pro plan
  • Subscriptions will automatically renew unless canceled prior to the renewal date

11.4 Google Play and App Store Specific Terms

For users subscribing through Google Play on Android devices:

  • Subscriptions purchased through Google Play will be charged to your Google Play account
  • Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current period
  • You can manage and cancel your subscriptions by going to your account settings in the Google Play Store after purchase
  • If you cancel your subscription, you can use your subscription until the end of your current billing cycle
  • Google Play handles all payment processing, and any refund requests must be directed to Google Play according to their refund policy

For users subscribing through Apple App Store on iOS devices (coming soon):

  • Similar terms will apply in accordance with Apple's App Store policies

By purchasing a subscription through these platforms, you acknowledge and agree that you are also bound by the respective platform's terms of service.
